POLICY ON THE COLLECTION, PROCESSING, AND PROTECTION OF PERSONAL DATA

This Policy on the Collection, Processing, and Protection of Personal Data (the “Policy”) is issued and publicly disclosed by Chicland Hotel Joint Stock Company (“Chicland Hotel”) on its official website at https://chiclandhotel.com and shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam. By accessing or using any products or services of Chicland Hotel and/or entering into any transaction with Chicland Hotel by any means whatsoever, the Customer acknowledges that he/she/it has read, clearly understood, and voluntarily agrees to be bound by and comply with this Policy.

1. DEFINITIONS

For purposes of this Policy, the following terms shall have the meanings set forth below:

  • “Products” means all products and services performed and/or provided by Chicland Hotel within the scope of its registered business lines and operations.

  • “Services” means all services performed and/or provided by Chicland Hotel within the scope of its registered business lines and operations.

  • “Customer” means any organization or individual who is also a data subject, including but not limited to organizations and individuals who interact, transact, access, provide, or use the Products of Chicland Hotel (including, without limitation, transactions conducted directly at Chicland Hotel’s premises, via online platforms, and/or through any other means), as well as organizations and individuals participating in Chicland Hotel’s programs or events.

  • “Personal Data” means information or data of a Customer in the form of symbols, writing, numerals, images, sounds, or similar forms in an electronic environment that is associated with a specific individual or helps identify a specific individual, including but not limited to information and data relating to full name, date of birth, gender, nationality, citizen identification information, personal identification number, passport number, marital status, transaction information, and access history. In addition, certain information or data of a sensitive nature, such as race, health information, religious beliefs, political opinions, biometric data, Customer location data, and other similar information, may be collected and processed by Chicland Hotel where necessary and in accordance with applicable law.

  • “Processing of Personal Data” means any operation or set of operations performed by Chicland Hotel on a Customer’s Personal Data, whether or not by automated means, including but not limited to collection, recording, analysis, verification, storage, modification, disclosure, combination, access, retrieval, recovery, encryption, decryption, copying, sharing, transmission, provision, transfer, deletion, destruction, or other relevant activities.

Chicland Hotel utilizes the following data analytics tools:

  • Cookies are small text files stored on a Customer’s device when the Customer accesses our Website. Cookies enable the Website to remember information about visits, such as language preferences, content viewed, or actions taken, in order to enhance user experience and support analytics, personalization, and advertising activities.

  • Pixel Tags – Google Tags are code snippets embedded in the Website to track user behavior (such as page views, adding items to cart, and purchases). They are used to improve the effectiveness of advertising activities, including remarketing, conversion measurement, and advertisement optimization.

  • “Do Not Track” Feature is a browser setting that users may enable to request that websites refrain from collecting or tracking their browsing data. When this feature is enabled, Cookies, Pixel Tags, and Google Tags will not collect or store the Customer’s browsing data. As a result, the Customer may need to reconfigure certain personalized settings each time he/she/it accesses our Website. If a Customer’s browser has enabled the “Do Not Track” feature, we will respect such preference. Customers may disable this feature at any time.

Chicland Hotel shall not use Cookies, Pixel Tags, or Google Tags for any purposes other than those expressly outlined in this Policy.

2. CATEGORIES OF PERSONAL DATA COLLECTED

At various touchpoints throughout your journey as our Customer, we collect Personal Data in accordance with applicable law to deliver consistent, high-quality services. “Personal Data” refers to information that identifies you as an individual or relates to you as an identifiable individual. We collect and process the following categories of Personal Data concerning you:

General Identification Information, including full name, mailing address, email address, telephone number, social media account ID, profile photo, and other publicly available data or data provided through linking your social media account with your loyalty account, or other similar identifiers.

Demographic Information and Important Dates, including gender, language preference, nationality, date of birth, anniversary dates, and other special occasions.

Government-Issued Identification, including passport, visa, or other government-issued identification documents (and the Personal Data contained therein).

Financial Information, including credit card, debit card, and other payment-related data.

Travel Information, including prior stays or interactions (including interactions via our chat functionality), goods and services purchased, special service requests and amenities, travel itinerary, travel group information, activity data, and employer details (for business-related bookings).

Health Information: including information collected in connection with the provision of our spa, wellness, and beauty services.

Other Information: In more limited circumstances, we may also collect:

  • Data relating to family members and travel companions (including children’s names and ages);

  • Biometric data;

  • Images, video, and audio data collected through voice recordings (for example, when customer service calls are recorded for quality assurance purposes); security cameras located in public areas such as corridors and lobbies within our premises; and body-worn cameras used by loss prevention personnel and other security staff.

We may also collect information regarding your “Preferences” whether provided by you or recorded during your stay, in order to enhance your experience both presently and in the future. Such Preferences may include your “Interests and Passions” (e.g., golf, spa, or other on-property activities); “Food and Beverage” preferences, which may include health-related restrictions or personal requirements to better support your well-being; and “Room and Stay” preferences, including room selection, amenities, and likes and dislikes to improve our Services. Additional Preferences may include details regarding individuals with whom you frequently travel, your relationship with such individuals, special dates such as anniversaries and birthdays, and your marital status.

If you submit any Personal Data relating to another individual to us or to our Service Providers (for example, if you make a reservation for another person), you represent and warrant that you have the authority to do so and that you authorize us to use such data in accordance with this Privacy Policy.

We may also collect “Other Data” that does not directly reveal your specific identity. To the extent that such Other Data reveals your specific identity or relates to an identifiable individual, we will treat such Other Data as Personal Data.

Other Data includes:

System Data When Customers use a desktop computer or mobile device to access our Online Services, we may collect certain data through the browser or automatically through the device, such as computer type, screen resolution, operating system name and version, device manufacturer and model, language, internet browser type and version, and the name and version of the Online Services being used.

Precise Location-Based Services With your consent, we may collect the precise geolocation of your device using satellite, cellular tower, Wi-Fi signals, or other technologies. We will collect such data if you opt in through our Application or other program (either upon initial login or thereafter) for the purpose of enhancing special offers and enabling location-based features on your device, such as identifying nearby hotels, locating airport shuttle services, displaying maps, and providing directions. If you have chosen to share your location, the Application or other program will continue to collect location data in accordance with your selected sharing preferences.

Choices Regarding Precise Location Sharing Users may designate, through their device operating system settings (such as via the “Settings” icon), whether to share location data at all times, only while using the Application, or never. If you choose to share location data only while using the Application, we will have access to such data until you log out of or close the Application, or until you disable location services for the Application or other program through your device settings.

3. METHODS OF COLLECTION OF PERSONAL DATA

Through software applications (including automated tools and chat functionalities) made available by us for use on or through computers and mobile devices (collectively, our “Applications”);

HOW AND WHERE WE COLLECT YOUR DATA

This Privacy Policy describes the privacy practices of Chicland Hotel with respect to Personal Data and Other Data that we collect through the following:

  • Chicland Hotel. We collect Personal Data and Other Data from other companies for the purposes described in this Privacy Policy, such as providing and personalizing the Services, communicating with you, and facilitating our business purposes.

  • On-Property and Travel Service Providers. We may collect your Personal Data and Other Data from spas, restaurants, fitness clubs, guest service departments, and other outlets at our properties.

  • Linked Accounts. We collect Personal Data and Other Data when you use a Loyalty Program code or Online Services login credentials to receive or register for certain third-party services. These companies include businesses such as airlines, car rental companies, restaurant reservation companies, and transportation service companies. In addition, social media account providers allow customers to connect their social media accounts to their Online Services accounts or to log in to their Online Services accounts using their social media accounts. When you register for such services, we will disclose your Personal Data and Other Data to those third parties. If you do not want us to collect your Personal Data or Other Data in this manner, please do not provide your Loyalty Program code to third parties, do not use your Online Services login credentials to register for third-party promotions, and do not connect your Online Services account with accounts on third-party services.

  • Advertising Partners. We share Personal Data and Other Data with Advertising Partners, including companies such as Meta, Google, and other companies, in order to provide marketing, advertising, and promotional services to you.

  • Other Sources & Service Providers. We collect Personal Data and Other Data from various third parties, such as public databases, joint marketing partners, financial service providers, travel agents, and online travel providers. We may combine Data collected from other sources with Data collected from you or about you through the Services and use such Combined Data in accordance with this Privacy Policy and applicable law, including for marketing and advertising purposes.

  • Online Services.   • Through transactions established between the Customer and Chicland Hotel;

  • When the Customer searches, registers, logs in, creates, manages an account, accesses, transacts, or interacts through available Chicland Hotel channels (such as website, Facebook, Zalo, applications, etc.);

  • When the Customer accesses any electronic information page of Chicland Hotel or uses any feature or resource available on or through such page;

  • When the Customer downloads or uses Chicland Hotel’s mobile applications;

  • From exchanges and communications between Chicland Hotel and the Customer (in person, by mail, telephone, online, electronic communication, or any other means), including surveys, programs, events, and activities in which the Customer participates;

We share your Personal Data and Other Data used for making reservations with the relevant hotel in order to process and fulfill your reservation.

  • On-Property and Travel Service Providers. We may share your information with spas, restaurants, health clubs, and guest service departments located at our properties.

  • Advertising Partners. We share Personal Data and Other Data with Advertising Partners, including companies such as Meta, Google, and other similar entities, in order to provide marketing, advertising, and promotional services to you.

  • Service Providers. We disclose Personal Data and Other Data to third-party service providers, such as companies providing website hosting, automated chat features or AI-enabled technologies, data analytics, payment processing, reservation fulfillment, information technology and related infrastructure, customer service, email delivery, marketing, auditing, and other services.

Use and Disclosure of Other Information

We may use and disclose Personal Data as we believe to be necessary or appropriate:

For the purposes set out in this Policy and for other purposes to which the Customer has consented or as otherwise required by applicable law, the entities and individuals authorized to process the Customer’s Personal Data include the following:

  • Relevant internal personnel (including Front Office staff, Hotel Management, and Accounting personnel);

  • Advertising service providers and marketing partners;

  • Competent state authorities and regulatory bodies upon lawful request.. 

6. UPDATE, CORRECTION AND DELETION OF PERSONAL DATA

  • Customers have the right to access and review their Personal Data or to correct their Personal Data directly by logging into their account on the Website at https://chiclandhotel.com, or by requesting assistance from the Chicland Hotel administration.

  • Customers have the right to request that Chicland Hotel update, amend, or delete their Personal Data.

  • Customers are responsible for promptly updating and correcting their Personal Data with Chicland Hotel and for ensuring the accuracy and completeness of the Personal Data they provide.

Additional Information

For your protection, we will only process requests relating to Personal Data that are associated with the email address and/or loyalty account number that you confirm in your request. We may require verification of your identity before implementing certain requests.

7. RETENTION AND PROTECTION OF PERSONAL DATA

Retention Period Chicland Hotel retains Customers’ Personal Data in a form and manner appropriate to its operational activities and for a period consistent with the purposes of processing and the Customers’ requests.

The retention period shall depend on the purpose of processing, the Customer’s request, and/or any requirement of competent state authorities in accordance with applicable law. Personal Data shall be deleted, destroyed, or anonymized as soon as it no longer serves the retention purpose or upon receipt of a valid request from the Customer, unless otherwise required by law.

Unless otherwise provided by law, the commencement and termination of Chicland Hotel’s processing of Customers’ Personal Data shall be determined as follows:

  • Commencement: From the time the Customer provides consent permitting Chicland Hotel to process the Customer’s Personal Data in accordance with this Policy;

  • Termination: From the time Chicland Hotel completes the processing of the Customer’s Personal Data, or upon receipt of a request to cease processing and/or withdrawal of the Customer’s consent, and/or at such other time as prescribed by law;

  • Personal Data shall be securely stored on our Website at https://chiclandhotel.com until a deletion request is received from the data subject.

  • Chicland Hotel commits to processing Customers’ Personal Data in a secure and confidential manner and to safeguarding the lawful rights and interests of Customers in relation to Personal Data processing, within the operational capacity of Chicland Hotel and in accordance with applicable law. We implement appropriate data processing methods, together with suitable technical and organizational security measures, to prevent unauthorized access, reading, use, modification, disclosure, destruction, or other unlawful processing of Personal Data. However, the internet environment is not completely secure, and we cannot guarantee absolute security of Personal Data transmitted via the internet. Accordingly, Personal Data collected and stored may be subject to unauthorized access by third parties (such as hackers), which may cause potential impacts or damages to Customers. When using the internet to transmit Personal Data, Customers should use secure systems to access websites, applications, or devices. Customers are responsible for safeguarding their access credentials for each website, application, or device and must keep such information confidential. Customers shall promptly notify Chicland Hotel upon detecting any misuse of login information and immediately change their passwords. Chicland Hotel will use reasonable efforts to remedy and reinforce security measures and to mitigate any resulting damages.

Sensitive Personal Data

We collect Sensitive Personal Data only where necessary to reasonably perform the Services requested or where required by applicable law. Unless we expressly request such information, Customers are requested not to send or disclose to us, through or in connection with the Services (including via email), any Sensitive Personal Data, including but not limited to: social security numbers, taxpayer identification numbers, passport numbers, driver’s license numbers, or other government-issued identification numbers; credit or debit card details or financial account numbers (with or without any access code or password); credit history; or information relating to race, religion, ethnicity, sexual life or sexual orientation, health or medical information, genetic or biometric data, biometric identifiers, political or philosophical beliefs, political party or trade union membership, background check information, criminal records, or information relating to judicial or administrative proceedings.

Use of Services by Minors

The Services are not directed to children, and we do not knowingly solicit or collect Personal Data from children under eighteen (18) years of age without parental or legal guardian consent. We request that children do not provide Personal Data through the Services.

8. PRIVACY CHOICES & CUSTOMER PERSONAL RIGHTS

  • Customer Rights

    • Customers have the right to be informed about the processing of their Personal Data.

    • Customers have the right to consent or refuse to consent to the processing of their Personal Data. Customers may withdraw their consent at any time, subject to the relevant provisions of this Policy and applicable law.

    • Customers have the right to restrict and object to Chicland Hotel’s processing of their Personal Data in order to prevent or limit the disclosure of Personal Data or its use for advertising and marketing purposes that are inconsistent with this Policy and applicable law. Chicland Hotel shall respond to and implement the Customer’s request within seventy-two (72) hours of receipt.

    • Customers have the right to delete their membership account at any time. Upon deletion of the account, we will cease using and shall proceed to delete or anonymize the Customer’s Personal Data.

    • Customers have the right to request that Chicland Hotel provide their Personal Data in accordance with the following procedures:

      • Upon requesting access to Personal Data, the Customer or the Customer’s lawful representative shall submit a Personal Data Request Form (in the prescribed template) to Chicland Hotel either directly at Chicland Hotel’s headquarters, via Chicland Hotel’s official email address, or through postal services.

      • Chicland Hotel shall designate responsible personnel to receive and process the request and to maintain records of Personal Data disclosures. Where the requested Personal Data does not fall within Chicland Hotel’s authority, Chicland Hotel shall notify and guide the Customer to the competent authority or clearly inform the Customer of the inability to provide such data.

      • Within seventy-two (72) hours from receipt of a valid request, Chicland Hotel shall notify the Customer of the timeframe, location, and method of data provision; any actual costs incurred for printing, copying, postal delivery, or fax transmission (if applicable); and the payment method and deadline.

    • Customers have the right to lodge complaints, denunciations, or initiate legal proceedings in accordance with applicable law. Customers may submit complaints to the website administrator via Email: hotel@chicland.vn or hotline: 0236.223.2222. Upon receipt of such feedback, Chicland Hotel shall verify the information and, where the complaint is substantiated, take timely corrective action.

    • Customers have the right to claim compensation for damages in accordance with applicable law in the event of violations relating to the protection of their Personal Data.

    • Customers have the right to self-protection in accordance with applicable law or to request competent authorities or organizations to implement civil remedies, including recognition, respect, protection and assurance of civil rights; cessation of infringing acts; public apology and rectification; performance of obligations; compensation for damages; annulment of unlawful individual decisions issued by competent authorities, organizations, or persons; and other remedies as provided by law.

  • Customer Obligations

    • To safeguard their own Personal Data and request relevant organizations or individuals to protect their Personal Data.

    • To respect and protect the Personal Data of others.

    • To provide complete and accurate Personal Data when consenting to Chicland Hotel’s processing of such Personal Data.

    • To commit, represent, warrant, and assume full responsibility when providing Personal Data of third parties to Chicland Hotel. The Customer represents and warrants that he/she has obtained lawful authorization from such third party for the provision and processing of the Personal Data and has fully informed such third party of, and obtained consent to, all contents of this Policy, including consent for Chicland Hotel to process such third party’s Personal Data for one, several, or all of the purposes set out in this Policy.

    • To promptly notify, update, and supplement accurate Personal Data to Chicland Hotel in accordance with the purposes of processing.

    • To comply with the conditions (if any) applicable when exercising Customer rights under this Policy and applicable law.

    • To fulfill other obligations as provided in this Policy and applicable law.

9. CUSTOMER CONSENT AND WITHDRAWAL OF CONSENT

  • Customer Consent

    • Chicland Hotel respects and safeguards Customers’ information. Accordingly, Chicland Hotel shall process Customers’ Personal Data only for the purposes set out in this Policy and upon obtaining the Customer’s consent, unless otherwise provided by applicable law.

    • By agreeing to purchase Products of Chicland Hotel, the Customer acknowledges that he/she has been fully informed of and understands the contents of this Policy, including but not limited to: the categories of Personal Data processed by Chicland Hotel; the purposes of processing; the organizations and individuals authorized to process Personal Data; and the Customer’s rights and obligations.

    • A Customer shall be deemed to have consented to the processing of his/her Personal Data by Chicland Hotel upon performing any of the following actions:

      • Providing written confirmation when transacting directly at Chicland Hotel;

      • Registering for a membership card or becoming a loyalty member of Chicland Hotel;

      • Accessing or conducting transactions on Chicland Hotel’s online platforms (including website, Facebook, etc.);

      • Registering for or logging into an account on Chicland Hotel’s website.

    • By carrying out any of the foregoing actions, the Customer voluntarily consents to Chicland Hotel’s processing of his/her Personal Data in accordance with the processing purposes applicable from time to time.

    • In the event that the Customer does not consent to Chicland Hotel processing his/her Personal Data for any purpose, the Customer may submit a request to the contact details provided in this Policy. While Chicland Hotel respects the Customer’s choice, certain services or benefits may not be available as a result.

    • Where the Customer authorizes an organization or individual to act on his/her behalf in relation to procedures concerning the processing of Personal Data, the Customer or the Customer’s lawful representative must provide Chicland Hotel with a valid written authorization. If authorizing an individual, the authorization must be notarized or duly certified. If authorizing an organization, the authorization must bear the signatures of the Customer and the duly authorized representative of such organization. The authorization document must clearly state that the Customer has been fully informed of the policies and regulations relating to Personal Data processing and consents to Chicland Hotel processing the Customer’s Personal Data.

    • In relation to the processing of Sensitive Personal Data, Chicland Hotel shall notify the Customer that the data to be processed constitutes Sensitive Personal Data.

  • Withdrawal of Consent

    • Customers have the right to withdraw their consent to the processing of their Personal Data. To withdraw consent, the Customer must submit a request to Chicland Hotel in a format capable of being printed or reproduced in writing, including electronic or other verifiable formats.

    • Upon receipt of a request for withdrawal of consent, Chicland Hotel shall inform the Customer of the potential consequences or impacts that may arise from such withdrawal. Chicland Hotel shall cease processing and require relevant organizations and individuals to cease processing the Personal Data for which consent has been withdrawn.

    • The Customer acknowledges that withdrawal of consent shall not affect the lawfulness of processing carried out based on consent prior to its withdrawal.

    • Chicland Hotel may process Personal Data without the Customer’s consent in the following circumstances:

      • In emergencies where immediate processing of relevant Personal Data is necessary to protect the life or health of the Customer or another person;

      • Where disclosure of Personal Data is required by law;

      • For the performance of obligations under agreements and/or contracts between the Customer and relevant agencies, organizations, or individuals as prescribed by law;

      • To serve the activities of competent state authorities in accordance with applicable law;

      • Other cases as provided by law.

  • Additional Information

To protect you, we will respond only to requests concerning Personal Data associated with the email address and/or loyalty account number that you confirm in your request, and we may require identity verification before fulfilling certain requests.

We will endeavor to respond to your request as soon as reasonably practicable and in accordance with applicable law. Please note that certain Personal Rights may not be available under applicable law to all Customers or to individuals using our Services
